SCHEDULING ASSIGNMENTS

FOR

CONCORD, MARLBOROUGH, LOWELL & DOR SESSIONS

CONCORD & MARLBOROUGH

Each judge assigned to sit in either Concord or Marlborough will hear an unlimited number of uncontested matters (motions, divorces, guardianships, etc.), with pretrial conferences and up to six contested motions.  (Overrides may be granted, but only by the judge assigned to hear the matter.)  As noted, each Judge will hear up to eight pretrial conferences for cases assigned to her/him under the individual calendar numbering system; those cases will be assigned at the following times:

  • 3 at 9:00 AM
  • 2 at 11:00 AM
  • 3 at 2:00 PM

Trials and original contempts will not be scheduled for either Concord or Marlborough.  In addition, provided arrangements are made well in advance in order to have the case file transferred from Cambridge to a particular satellite session, any judge sitting in a satellite session will hear any uncontested divorce or full agreement on a complaint for modification, regardless of the judge to whom it is otherwise assigned.

LOWELL

The judge sitting in the Lowell session will hear any and all matters for which a request is received that the matter be heard in the Lowell session, except contempts and multi-day trials, regardless of which judge is assigned to the case under the individual calendar numbering system.  If a case is pretried in the Lowell session, it may be assigned a trial date in the Lowell session, but only if it is a one day trial.  (One day trials may be double booked, particularly if the cases involve pro se litigants.)  If a case is pretried in the Lowell session and requires more than a single day of trial, a trial date shall not be established, but a status conference date shall be assigned before the judge who, under the individual calendar numbering system, is assigned to the case.  The status conference should be assigned for 9:00 am on any date when the assigned judge is scheduled to hear pretrial conferences (whether in Cambridge, Concord or Marlborough.)

DOR
